Three commercial brokers left a nationally renowned brokerage firm. Contrary to their employment agreement, they attempted to steal a pending transaction. Upon learning of their malfeasance, and as the commission check was being issued, the attorneys at C. Kyle Pugh, P.C. filed a claim for arbitration and an additional lawsuit, which stopped the attempted theft. The arbitrator found the three brokers guilty of conspiring to commit fraud, actually committing fraud, and breaching their contracts. Our client was awarded $875,219 in damages. The case was settled for $775,000 pending confirmation of the arbitration award. in state and federal court.
A national sales director abruptly resigned his position with an international manufacturing firm. When he resurfaced a month later, he had formed a company (with partners) that was directly competing with our client. We quickly conducted a forensic analysis of his computers and documented that he had downloaded all of our client’s trade secrets including client lists and proprietary pricing. We quickly filed suit and obtained a temporary restraining order against the former director. We then notified his new partners that they were complicit in the theft of our trade secrets. The case quickly resolved when the new company terminated the former director, and a final judgment and permanent injunction were entered against him.
A Dallas-based company employed our client to provide Information Technology services. Upon completion, the company decided not to pay our client. The attorneys at C. Kyle Pugh, P.C. promptly sued the company and its president in his individual capacity. A judgment was obtained and we collected the judgment in full, including our client’s attorney’s fees and costs.
